1. Introduction to the Anatole Platform

Anatole is an online platform enabling couples to create and manage their digital wedding invitations. Anatole provides a web-accessible service allowing users to create personalized wedding pages, send invitations via email and SMS, manage attendance confirmations (RSVP), and organize a wedding gift registry.

The company KAWLET EURL (hereinafter "Anatole" or "the Service Provider") acts as a technical service provider, offering invitation management and attendee tracking tools.

These Terms of Use define the legal framework for the use of the Anatole platform by any User (couple organizing their wedding). By creating an account or using Anatole's services, the User unconditionally accepts these Terms of Use.

Scope of application: The Anatole platform is primarily intended for individuals (consumers as defined by French consumer protection law) wishing to organize their wedding. Consumer protection provisions, including the right of withdrawal provided in Articles L221-18 et seq. of the French Consumer Code, apply in full.

2. Definitions

For the purposes of these Terms, the following terms shall have the meanings set forth below:

  • User: the individual or couple who uses the Anatole platform to organize their wedding and manage their invitations. The User is considered the Data Controller under the GDPR for the personal data of guests that they import onto the platform.
  • Guest: the individual invited to the wedding, whose data (name, email, phone) is processed via Anatole for invitation purposes. The Guest is the Data Subject for data processing carried out on behalf of the User.
  • Service Provider: the company KAWLET EURL, providing the Anatole SaaS platform. Anatole acts as a Data Processor under the GDPR for the processing of Guest data carried out on behalf of the User.
  • Services: all functionalities made available by Anatole, including the creation of wedding pages, sending invitations via email/SMS, tracking responses (RSVP), managing wedding moments, the gift registry, and any other tools related to wedding organization.
  • GDPR Data Processing Agreement: the agreement incorporated by reference into these Terms and detailing the conditions for processing personal data in accordance with Article 28 of the GDPR. The Agreement is available online at /en/dpa.

3. Purpose of the Terms and platform access

3.1. Purpose

These Terms of Use are intended to define the rights and obligations of Anatole and the User in connection with the use of the platform. They govern Anatole's liability towards the User and third parties, and require the User to comply with applicable laws.

Anatole grants the User a right to access and use the platform, in the form of a SaaS service license, for the duration of this agreement. This right is non-exclusive, personal, and may not be assigned to a third party without Anatole's consent.

3.2. Account creation and acceptance

To use the Services, the User must create an account by providing accurate and complete information (first name, last name, email address, etc.). The User is responsible for maintaining the confidentiality of their login credentials. Any action performed via their account is deemed to have been performed by the User.

Acceptance of the Terms of Use and the GDPR Data Processing Agreement is required when creating the account. This electronic acceptance has the same value as a handwritten signature. The User acknowledges that the Terms may be updated by Anatole during the term of the agreement, with prior notice. Continued use of the Services after modification constitutes acceptance of the updated Terms.

4. Description of Services and authorized use

Anatole allows the User to manage invitations for their wedding. Main features include:

  • Creating a personalized wedding page with couple information, date, locations, and program.
  • Managing a multi-moment schedule: civil ceremony, religious ceremony, cocktail hour, dinner, party, next-day brunch, etc.
  • Importing or entering a guest list with contact details (name, email, phone).
  • Sending personalized invitations via email and/or SMS to Guests.
  • Tracking responses (attendance confirmations per moment, declines, number of plus-ones).
  • Collecting guests' dietary preferences and restrictions.
  • Managing a gift registry allowing guests to contribute financially.
  • Allowing guests to upload photos to a shared album.
  • Inviting co-hosts to participate in wedding management.

The User agrees to use the platform solely for legitimate wedding organization purposes. Any abusive use of the Services is prohibited. In particular, the User must not:

  • Use Anatole to send messages unrelated to their wedding.
  • Transmit unlawful, defamatory, hateful, or obscene content.
  • Infringe upon the rights of third parties (privacy, intellectual property).
  • Misuse the platform for harmful purposes (viruses, intrusion, etc.).

Anatole reserves the right to suspend any account in case of unlawful or abusive use of the Services.

5. Legal compliance and User obligations

5.1. Lawfulness of contact lists

The User is solely responsible for the lawfulness of their guest list. By using Anatole, the User agrees to:

  • Only invite people with whom they have a personal relationship (family, friends, close colleagues) and who could reasonably expect to receive an invitation to their wedding.
  • Ensure that guests can easily unsubscribe if they no longer wish to receive communications.
  • Respect the rights of individuals whose data is processed.

5.2. Respecting guests' privacy

The User must inform their guests about the processing of their data. In particular, they must:

  • Inform guests that their data is managed via Anatole.
  • Honor any request from a guest to exercise their rights (access, rectification, deletion).

If Anatole receives such a request directly from a Guest, Anatole will promptly forward it to the User.

5.3. Indemnification

The User guarantees and will indemnify Anatole against any consequences resulting from non-compliance with the legal and contractual obligations set forth in these Terms, particularly in the event of a complaint from a guest regarding unauthorized use of their data.

6. Anatole's liability and warranties

6.1. Best efforts obligation and service availability

Anatole undertakes to provide the Services professionally and with a best efforts obligation. Anatole will make its best efforts to ensure the proper functioning and availability of the platform. The User is informed that the Services may occasionally be interrupted for maintenance or updates.

Anatole cannot be held liable for unavailability due to telecommunications networks, external providers, or force majeure events.

6.2. User data and content

The User remains fully the owner and responsible for the data they import into the platform (guest list, invitation content, photos, etc.). Anatole does not acquire any ownership rights to this data.

Anatole cannot be held liable in the event of destruction, loss, or accidental disclosure of data resulting from acts or omissions by the User.

6.3. Limitation of liability

To the extent permitted by law applicable to consumers, if Anatole's liability were to be engaged for damages suffered by the User, the amount of compensation shall be limited to the amount actually paid by the User to Anatole for the service concerned.

This limitation does not apply in cases of gross or intentional misconduct, personal data breaches, or failure to meet essential security obligations.

7. Personal data protection

Personal data protection is at the heart of Anatole's concerns. The Parties declare their compliance with Regulation (EU) 2016/679 (GDPR) and applicable national laws.

7.1. Roles of the parties

In connection with the use of the platform:

  • The User is the Data Controller for Guest data processed via Anatole. As such, they are responsible for complying with all legal obligations.
  • Anatole is the Data Processor within the meaning of Article 28 of the GDPR. Anatole processes Guest data solely on behalf of and on the instructions of the User, for the purpose of providing the service.

In addition, Anatole may process certain User data as a separate Data Controller (account data, history). These processing activities are described in the Privacy Policy.

7.2. GDPR Data Processing Agreement

In accordance with Article 28 of the GDPR, the conditions under which Anatole processes personal data on behalf of the User are defined in the [GDPR Data Processing Agreement](/en/dpa).

The Agreement is incorporated by reference into these Terms. By accepting the Terms, the User also accepts the Agreement.

In the event of a conflict between a provision of the Terms and a provision of the Agreement regarding the processing of personal data, the provision of the Agreement shall prevail.

8. Right of withdrawal

In accordance with Articles L221-18 et seq. of the French Consumer Code, consumer Users have a 14-day right of withdrawal from the conclusion of the agreement (account creation and/or subscription to a paid offer).

8.1. Exercise of the right of withdrawal

To exercise this right, the User must notify their decision to withdraw by means of an unambiguous statement (for example, email to hello@anatole.wedding or via the contact form).

8.2. Exception for services already started

In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised if the performance of the Services has begun with the User's express consent and if the User has acknowledged losing their right of withdrawal.

When subscribing to a paid offer, if the User wishes the Services to begin immediately (before the expiration of the 14-day period), they must make an express request and acknowledge that they will then lose their right of withdrawal for services already performed.

8.3. Refund

In the event of valid withdrawal, Anatole will refund the User for all payments received, without undue delay and no later than 14 days from receipt of the withdrawal notification.

9. Term, termination, and modifications

9.1. Term of the agreement

The Terms come into effect upon acceptance by the User during registration and are concluded for an indefinite period. The agreement remains in effect as long as the User has an active account or uses the Services.

The User may at any time stop using the Services and request closure of their account. Any service already started remains due.

9.2. Termination

Either party may terminate the agreement in the event of a serious breach by the other party of its obligations, not remedied within 30 days after written notice.

In the event of termination, for whatever reason, the User will remain bound to comply with provisions that by their nature survive (liability, data protection, confidentiality).

After account closure, Anatole will proceed with the deletion or return of data in accordance with the GDPR Data Processing Agreement.

9.3. Modification of the Terms

Anatole reserves the right to modify these Terms. The User will be informed of any substantial modification with at least 30 days' notice. During this period, Users who refuse the new terms may terminate the agreement without penalty.

10. Consumer mediation

In accordance with Articles L611-1 et seq. of the French Consumer Code, in the event of a dispute not resolved with Anatole, consumer Users have the right to use a consumer mediator free of charge.

Competent mediator: The User may contact the mediator of their choice from among those listed by the Commission for the Evaluation and Control of Consumer Mediation (CECMC) or via the European Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr

Before contacting the mediator, the User must have attempted to resolve their dispute directly with Anatole by sending a written complaint to hello@anatole.wedding.

11. Applicable law and dispute resolution

These Terms are governed by French law.

In the event of a dispute relating to the validity, interpretation, or performance of these Terms, the Parties will attempt to find an amicable solution. Failing an amicable agreement, and after failure of mediation for consumers, the dispute will be submitted to the competent French courts.

For consumers residing in the European Union: In accordance with Regulation (EU) No 524/2013, you may also use the EU Online Dispute Resolution platform to file a complaint: https://ec.europa.eu/consumers/odr.

12. Miscellaneous provisions

Entire agreement: The Terms, including the GDPR Data Processing Agreement and the Privacy Policy, constitute the entire agreement between Anatole and the User regarding the use of the Services.

Severability: If any provision of these Terms is declared null or unenforceable, it will be deemed unwritten but will not affect the validity of other provisions.

Non-waiver: Anatole's failure to enforce a provision of the Terms shall not be interpreted as a waiver of the right to enforce that provision.

Assignment: The agreement may not be assigned by the User without Anatole's prior written authorization.
