Article 1. Service provider identification and scope

1.1 Service provider

These Terms and Conditions of Sale govern the commercial relationship between KAWLET, a single-member limited liability company with capital of €1,000.00, with registered office at 15 Square Rameau, 59000 Lille, France, registered in the Lille Métropole Trade and Companies Register under number 993 159 250, SIRET 99315925000014, hereinafter referred to as "Anatole" or "the Service Provider", on the one hand, and any person subscribing to a paid offer or placing an order for physical products on the Anatole platform, hereinafter referred to as "the Customer", on the other hand.

1.2 Consumer protection

These terms apply primarily to relationships with consumers as defined by French Consumer Code. The Customer benefits from all protective provisions of consumer law, including the right of withdrawal provided in Articles L221-18 et seq. of the Consumer Code.

1.3 Document integration

These Terms of Sale constitute the commercial foundation of the contract and work in conjunction with the Terms of Use available at /en/terms, the GDPR Data Processing Agreement accessible at /en/dpa, and the Privacy Policy available at /en/privacy. In case of conflict between these documents, the order of priority is as follows: GDPR Data Processing Agreement, Terms of Sale, Terms of Use, Privacy Policy.

Article 2. Service description

2.1 Nature of service

Anatole offers a Software-as-a-Service solution dedicated to creating digital wedding invitations, as well as an online store for personalised physical products related to weddings. This platform enables Customers to create personalised wedding pages, send invitations via email and SMS, manage RSVPs, organise a wedding gift registry, and order personalised printed products (photo prints, canvases, posters, magnets, guest gifts, thank-you cards).

2.2 Main features

The platform includes a personalized wedding page builder, multi-moment timeline management (ceremony, cocktail hour, dinner, brunch, etc.), multi-channel invitation delivery infrastructure (email via Postmark, SMS via Twilio), real-time RSVP management system, dietary preference collection, Stripe-integrated gift registry module, shared photo albums, and the ability to invite co-hosts.

2.3 Technical infrastructure

All data is hosted exclusively within the European Union via Supabase infrastructure. The service aims for 99.5% availability excluding scheduled maintenance. Security is ensured through TLS 1.3 encryption in transit and AES-256 encryption for data at rest.

2.4 Store — Personalised physical products

Anatole operates an online store enabling Customers to order personalised physical products featuring their own photographs: premium paper photo prints, stretched canvases, posters, magnets, guest gifts and thank-you cards.

The manufacture and dispatch of physical products are carried out by the production partner Prodigi (Prodigi Group Ltd, United Kingdom), a sub-contractor specialising in print-on-demand. Anatole acts as the seller and remains the Customer's sole point of contact for any matter relating to their order. The Customer has no direct contractual relationship with Prodigi.

Article 3. Pricing terms

3.1 Freemium model

Anatole operates on a freemium model: a free tier with basic features, and paid tiers unlocking advanced functionality. Prices are stated in euros, including all applicable taxes.

3.2 Free tier

The free tier allows creating a wedding page with essential features: personalized page, limited guest management, limited invitation sends, and basic RSVP. Certain advanced features (premium themes, unlimited guests, gift registry, data export, etc.) are reserved for paid tiers.

3.3 Premium tiers

Paid tiers are presented on the site's pricing page. They may include: unlimited guests, access to all themes and customizations, gift registry functionality, photo albums, data exports, priority support. Pricing is subject to change, but applicable rates are those displayed at the time of subscription.

3.4 Gift registry commission

For the gift registry functionality (participatory wedding list), Anatole may charge a commission on contributions received. The applicable commission rate is clearly indicated before activating the feature. Stripe payment processing fees are separate and also disclosed.

3.5 Store — Physical product pricing

Prices of physical products are displayed in the currency corresponding to the Customer's delivery country (EUR, USD, GBP, AUD, BRL, RON, VND, TRY, CHF). Prices include the applicable VAT for the delivery country where required. Delivery charges are calculated based on the destination and chosen shipping method, and are displayed to the Customer before order validation.

Prices are subject to change at any time. The applicable prices are those displayed at the time the Customer validates the order. Exchange rates applied are indicative and may differ slightly from bank rates at the time of the charge.

Article 4. Pre-contractual information

4.1 Essential characteristics

In accordance with Article L111-1 of the Consumer Code, before any subscription, the Customer is informed of the essential characteristics of the service:

  • Nature of service: Digital wedding invitation platform
  • Price: Displayed in euros including all taxes on the pricing page
  • Delivery time: Immediate access after payment
  • Duration: Until wedding date + 90 days (or as per subscribed tier)
  • Right of withdrawal: 14 days (see Article 6)

Article 5. Order and payment terms

5.1 Subscription process

Subscription to paid tiers is completed via the secure form on the website. The Customer selects the desired tier, accepts these Terms of Sale and the Terms of Use, and proceeds with payment. An order confirmation is sent by email.

5.2 Payment methods

Payments are processed by credit card via the secure Stripe platform. Accepted payment methods include: Visa, Mastercard, American Express, Apple Pay, Google Pay. No banking data is stored by Anatole.

5.3 Invoicing

An invoice is issued for each payment and sent by email to the Customer. Invoices are archived and accessible in the customer account area.

5.4 Contract formation

The contract is formed upon payment validation. Access to premium features is immediate after payment confirmation.

5.5 Physical product orders (Store)

For personalised physical products, the order process is as follows:

1. Product selection: The Customer selects a product, uploads their photograph(s), and chooses the desired format and quantity. 2. Cart: The Customer may add multiple products to their cart before placing an order. 3. Summary and payment: The Customer reviews the order summary (products, quantities, unit prices, delivery charges, total amount including all taxes), enters their delivery address and proceeds to secure payment via Stripe. 4. Confirmation: An order confirmation email is sent to the Customer. The contract of sale is formed upon receipt of payment. 5. Manufacture: The order is transmitted to the production partner for manufacture. Once dispatched, an email containing tracking information is sent to the Customer.

The Customer is informed that, as the products are manufactured on demand using their personal photographs, the order enters production upon receipt of payment and can no longer be modified or cancelled after that point.

Article 6. Right of withdrawal

6.1 Withdrawal period

In accordance with Article L221-18 of the Consumer Code, the Customer has a period of fourteen (14) days to exercise their right of withdrawal, without having to provide justification. This period runs from the day of contract conclusion (payment validation).

6.2 Exercising the right of withdrawal

To exercise the right of withdrawal, the Customer must notify their decision to withdraw by means of an unambiguous statement (for example, email or contact form).

6.3 Model withdrawal form

6.4 Exception: Immediate service execution

In accordance with Article L221-28 of the Consumer Code, the right of withdrawal cannot be exercised for contracts for the supply of services fully performed before the end of the withdrawal period and whose performance began with the prior express agreement of the consumer, who also acknowledged losing their right of withdrawal.

In practice: When subscribing, if the Customer wishes to access premium features immediately (before the 14-day period expires), they will be asked to: 1. Expressly confirm that they wish performance to begin immediately 2. Acknowledge that they will lose their right of withdrawal if the service is fully performed

If the Customer does not accept these conditions, they retain their 14-day right of withdrawal, but access to premium features will be deferred.

6.5 Refund

In case of valid withdrawal, Anatole will refund the Customer for all payments received, without undue delay and no later than fourteen (14) days from receipt of the withdrawal notification.

The refund is made using the same payment method as used for the initial transaction, unless the Customer expressly agrees to another method.

If the service has begun to be performed with the Customer's agreement during the withdrawal period, a proportional amount for the service already provided may be withheld.

6.6 Exception — Personalised products (Store)

In accordance with Article L221-28 3° of the Consumer Code, the right of withdrawal does not apply to contracts for the supply of goods made to the consumer's specifications or clearly personalised.

The physical products ordered via the Anatole Store (photo prints, canvases, posters, magnets, guest gifts, thank-you cards) are manufactured on demand from the Customer's personal photographs. They constitute clearly personalised goods within the meaning of the law.

Accordingly, no right of withdrawal may be exercised in respect of orders for personalised physical products. Any order validated and paid for is firm and final.

However, in the event of a manufacturing defect, non-conformity of the product received or damage occurring during transit, the Customer may exercise their rights under the statutory warranty of conformity (see Article 9.4).

Article 7. Service performance

7.1 Performance terms

Access to premium features is granted immediately after payment validation (or at the end of the withdrawal period if the Customer has not requested immediate performance). Services are entirely digital and accessible 24/7 via internet connection.

7.2 Service duration

Access to premium features is valid until the wedding date entered by the Customer, plus an additional 90 days to allow data consultation and export. After this period, the account reverts to the free tier.

7.3 Anatole's obligations

Anatole commits to maintaining 99.5% service availability excluding scheduled maintenance, ensuring proper operation of premium features, and providing customer support by email.

7.4 Delivery of physical products (Store)

Products ordered via the Store are manufactured on demand and then dispatched directly to the Customer by the production partner. Indicative lead times are as follows:

  • Manufacture: 2 to 5 business days after payment validation
  • Shipping to the European Union: 3 to 7 business days
  • Shipping to the United Kingdom: 3 to 7 business days
  • Shipping to North America: 5 to 12 business days
  • Shipping to Brazil: 10 to 20 business days
  • Shipping to Asia-Pacific: 7 to 14 business days
  • Other destinations: 7 to 21 business days

These lead times are given for guidance only and may vary depending on the product ordered, the destination and the period. Anatole undertakes to inform the Customer of any significant delay. The Customer will receive a dispatch confirmation email with tracking information as soon as the parcel is collected by the carrier.

7.5 Delivery charges

Delivery charges are calculated based on the destination, weight and volume of the products ordered. The exact amount of delivery charges is communicated to the Customer before order validation. Delivery charges are non-refundable, except in the event of non-delivery attributable to Anatole or its production partner.

7.6 Transfer of risk

In accordance with Article L216-4 of the Consumer Code, the transfer of risk takes place at the moment the Customer, or a third party designated by the Customer, takes physical possession of the goods. In the event of loss or damage to the parcel during transit, the Customer must contact Anatole at hello@anatole.wedding within 48 hours of delivery. Anatole will handle the claim with the carrier and, where applicable, arrange for re-dispatch or a refund of the product.

7.7 Non-delivery

In accordance with Article L216-2 of the Consumer Code, if the product is not delivered within thirty (30) days of the order date (unless a longer period has been agreed), the Customer may terminate the contract by recorded delivery letter or email after having required Anatole to effect delivery within a further reasonable period. A full refund (product and delivery charges) will be made within fourteen (14) days of contract termination.

Article 8. Wedding cancellation

8.1 Refund in case of cancellation

In case of wedding cancellation (for any reason), the Customer may request a refund of their paid tier in the form of credit or partial refund, under the following conditions:

  • More than 6 months before scheduled date: Full refund or credit valid for 24 months
  • Between 3 and 6 months: 50% refund or credit valid for 24 months
  • Less than 3 months: Credit valid for 24 months

To benefit from this measure, the Customer must contact Anatole at hello@anatole.wedding.

8.2 Wedding postponement

In case of wedding postponement, the Customer may modify their wedding date in their account area free of charge. The premium feature access duration will be recalculated based on the new date.

Article 9. Liability and warranties

9.1 Best efforts obligation

Anatole commits to providing services under a best efforts obligation, in accordance with professional standards and market best practices. This obligation includes maintaining service availability, data security, and continuous feature improvements.

9.2 Liability limitations

Within the limits permitted by applicable consumer law, Anatole shall not be held liable for damages resulting from force majeure, Customer fault (misuse, erroneous data), or malfunctions attributable to third parties (networks, operators).

Anatole's financial liability is limited to the amount actually paid by the Customer for the relevant tier.

9.3 Statutory warranty of conformity — Digital services

In accordance with Articles L217-3 et seq. of the Consumer Code, the Customer benefits from the statutory warranty of conformity for digital content and services. This warranty covers conformity defects existing at the time of service provision or appearing within 24 months thereafter.

In case of non-conformity, the Customer may obtain service conformity or, if this proves impossible or would entail disproportionate costs, a price reduction or contract termination.

9.4 Statutory warranty of conformity — Physical products (Store)

In accordance with Articles L217-4 et seq. of the Consumer Code, physical products sold via the Store benefit from the statutory warranty of conformity for a period of two (2) years from delivery.

This warranty covers in particular: - Manufacturing defects (defective printing, incorrect cutting, damaged substrate) - Non-conformity of the product with the order (wrong format, wrong product delivered) - Damage occurring during transit

Not covered by the warranty of conformity: - Minor colour discrepancies between the on-screen display and the printed result, inherent in the technological differences between screens and printing processes - Defects resulting from photographs supplied by the Customer at insufficient resolution, despite warnings displayed at the time of ordering - Normal wear and tear of the product

In the event of a defect covered by the warranty, the Customer must contact Anatole at hello@anatole.wedding enclosing photographs of the defect observed. Anatole will, at the Customer's choice and subject to feasibility, arrange for reprinting and re-dispatch of the product at its own expense, or issue a full refund for the defective product.

9.5 Statutory warranty against hidden defects

In accordance with Articles 1641 to 1649 of the Civil Code, the Customer also benefits from the statutory warranty against hidden defects. If a hidden defect rendering the product unfit for its intended use is discovered, the Customer may choose between rescission of the sale or a reduction in the price, in accordance with Article 1644 of the Civil Code.

Article 10. Consumer mediation

10.1 Recourse to mediator

In accordance with Articles L611-1 et seq. of the Consumer Code, in case of unresolved dispute with Anatole, the consumer Customer has the right to use a consumer mediator free of charge.

Before contacting the mediator, the Customer must have attempted to resolve their dispute directly with Anatole by sending a written complaint to hello@anatole.wedding.

10.2 European platform

The Customer may also use the European online dispute resolution platform: https://ec.europa.eu/consumers/odr

Article 11. Duration and termination

11.1 Contract duration

These terms enter into force upon acceptance and are valid for the duration of the subscribed tier (until wedding date + 90 days, or according to specific tier conditions).

11.2 Termination by Customer

The Customer may stop using the Services at any time and request account closure. Payments already made are non-refundable (except right of withdrawal or wedding cancellation per Article 8).

11.3 Termination by Anatole

Anatole may terminate the contract in case of serious breach by the Customer of the Terms of Use (unlawful use, non-payment). The Customer will be notified by email before any suspension or termination.

Article 12. Governing law and jurisdiction

12.1 Governing law

These terms are exclusively governed by French law, in accordance with the Civil Code, Commercial Code, Consumer Code, and the European General Data Protection Regulation (GDPR).

12.2 Jurisdiction

In case of dispute, and failing amicable resolution or successful mediation, French courts have jurisdiction. In accordance with Article R631-3 of the Consumer Code, the consumer Customer may choose to file with: - The court of the place where they resided at the time of contract conclusion - The court of the place where they reside - The court of Anatole's registered office (Lille)
